This Privacy Policy (“Privacy Policy”) describes how Fluxon Apps LLC and its subsidiaries and affiliates ("Fluxon", "us", "we", or "our") collect, use, and share your personal information in connection with the websites and online platforms we own and operate that link to this Privacy Policy (collectively, the "Site"), our emails and other electronic communications, our social media pages, and our related services, offerings, and events (collectively, and together with the Site, the “Platform”), and the rights and choices available to individuals with respect to their personal information. This Privacy Policy does not apply to personal information that we may store or maintain on behalf of the users of our Platform, where applicable.

We may update this Privacy Policy from time to time. We will notify you of changes by posting the new Privacy Policy on this page and changing the “Last Updated” date at the top of this page. In some cases, such as where required by law, we may notify you about any updates by sending you an email, posting a notice about the update on the Platform, or using other reasonable means. In all cases, your continued use of the Platform following posting or other notification of changes constitutes your acceptance of such changes. We encourage you to review this Privacy Policy periodically for any updates.

Collection of personal information

Personal Information You Provide. We may collect the following categories of personal information when you provide it to us on or otherwise in connection with the Platform:

  • Contact information, such as first and last name, email address, and phone number.
  • Professional information, such as the name of the company you work for and its location, company description and job title, and company email and phone.
  • Order information, such as subscription information and order history.
  • Transaction information, such as the amount of your order, your payment card or bank account information, billing address, and other transaction details. We work with third-party payment processors who will collect and process payment card or bank account information for the Platform.
  • Account information, such as your account username and login information, profile details, and other details about your use of the Platform.
  • Preferences, such as your marketing or communication preferences.
  • Communications, such as the information associated with your requests or inquiries, including for support, assistance, or order information, chat history, and any feedback you provide when you communicate with us.
  • Content you provide, such as chat content, comments, responses, or other information that you submit to the Platform through any content submission, Q&A, or editor pages.
  • Other information that you choose to provide but is not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Personal Information Collected Automatically. When you use the Platform, we, our service providers, and our advertising partners may automatically log information about you, your computer, or mobile device, and your activity over time on our Platform and on other websites and online services, such as:

  • Online activity information, such as the website you visited before browsing to the Platform, pages or screens you viewed while using the Platform, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times, and duration of access.
  • Device information, such as your computer or mobile device operating system type and version number, wireless carrier, manufacturer and model, browser type, screen resolution, IP address, unique identifiers, and general location information such as city, state, or geographic area.

Like many online services, we use local storage as well as cookies and similar technologies to facilitate some of the automatic data collection described above, such as:

  • Cookies, which are text files that websites store on a visitor‘s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising.
  • Locally-stored objects, which are used on websites for purposes similar to cookies but allow storage of a larger amount of data.
  • Web beacons, also known as pixel tags or clear GIFs, which are typically used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked, typically to compile statistics about usage of websites and the success of marketing campaigns.

Personal Information Received from Third Parties. We may receive or collect personal information about you from third parties, such as our business and referral partners, our service providers, social media platforms, public information sources, third party platforms that you may choose to connect to your account on the Platform, and other third parties.

Referrals. You may have the opportunity to invite colleagues or other contacts to the Platform and share their contact information with us. Please do not provide us with someone’s personal information unless you have their permission to do so.

Sensitive Personal Information. Unless we specifically request it, we ask that you not provide us with any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Platform, or otherwise to us.

Use of personal information

We may use personal information for the purposes set forth below and as otherwise described in this Privacy Policy or at the time of collection.

To Provide the Platform and Our Products and Services. We may use your personal information to provide the Platform and our products and services, such as to:

  • provide and operate the Platform and our business;
  • create, manage, monitor, and maintain your account on the Platform;
  • provide you with the products and services you request;
  • monitor and improve your experience on the Platform;
  • review and respond to your inquiries and requests;
  • send you updates about your account;
  • contact you by phone, email, text, or other form of communication, including for account security and authentication purposes; and
  • process your transactions, send you receipts, and monitor your orders.

Research and Development. We may use your information for research and development purposes, including to study and improve the Platform and our business, understand and analyze the usage trends and preferences of our users, and develop new features, functionality, products, and services. As part of these activities, we may create aggregated, de-identified, or other anonymized data from personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes.

Direct Marketing. We may send you direct marketing communications as permitted by law. You may opt-out of our marketing communications as described in the “Your Choices” section below.

Interest-Based Advertising. We work with third-party advertising companies and social media companies to help us advertise our business and to display ads for our products and services and other products or services that may be of interest to you on the Platform and other locations. These companies may use cookies and similar technologies to collect information about you (including the online activity information and device information described above in the section called “Personal Information Collected Automatically”) over time and across our Platform and other sites and services or your interaction with our emails, and that information may be used to serve ads that such companies think will be of interest to you. In addition, some of these companies may use hashed customer lists that we share with them to deliver ads to you and to similar users on their platforms. To Comply with Laws and Regulations. We will use your personal information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.

Related Companies. We may share personal information with our affiliates, subsidiaries, and other related companies. For example, we may share your personal information with our related companies to provide our products and services to you where such companies perform components of the Platform.

Service Providers. We share personal information with third parties and individuals who perform functions on our behalf and help us run our business. For example, we may work with service providers that help us perform website hosting, maintenance, database management, security, cloud storage, web analytics, billing, email and text message services, payment processing, marketing, advertising, and other purposes.

Business Partners. We may share your personal information with our business partners, such as when we send information to a partner to offer a co-sponsored service or product or participate in any joint marketing efforts.

Advertising Partners. We may also share personal information collected about you with third parties who we partner with for advertising campaigns or that collect information about your activity on the Platform and on other sites and services for the purposes described in the “Interest-Based Advertising” section above.

Law Enforcement, Authorities, and Others. Under certain circumstances, we may disclose your personal information to law enforcement, government authorities, and other parties if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency). Fluxon is headquartered in the United States, and we may work with service providers in the United States and other countries. Your personal information may be collected, used, and stored in these countries or other locations outside of your home country. Privacy laws in the locations where we handle your personal information may not be as protective as the privacy laws in your home country. By providing your personal information, where applicable law permits, you hereby specifically and expressly consent to such transfer and processing and the collection, use, and disclosure set forth herein or in any applicable terms of service.

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from the risks presented by unauthorized access or acquisition, we cannot guarantee the security of your personal information.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password or username for access to certain parts of our Platform, you are responsible for keeping such information confidential. We ask you not to share your password or username with anyone and to select unique and secure passwords when setting up accounts in our Platform.

Your choices

In this section, we describe the rights and choices available to our customers.

Account Information. Depending on the services that you use, you may be able to access, modify, or remove certain information saved in your account by logging into your account and updating or correcting your profile information. You may also submit a request to delete your account by contacting us using the means provided at the bottom of this Privacy Policy.

Promotional Email Communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email or by contacting us as described below. You may continue to receive account, service-related, and other non-marketing emails.

Text Messages. We may offer text message programs as part of the Platform, for which messaging and data rates may apply. You may opt out of receiving text messages at any time by replying to our text message with the word “Stop” or by contacting us as described below. Please note that opting out of receiving text messages may impact your use of the Platform.

Third-Party Platforms. If you choose to connect the Platform with a third-party platform, you may have the ability to limit the information that we obtain from the third party at the time you create your account. You may also be able to control our access to your personal information through your account settings with the third-party platform. Please note, if you withdraw our ability to access certain information from a third-party platform, that choice will not apply to information that we have already received from that third party.

Cookies. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Platform and our Site may not work properly. The Platform is not intended for use by anyone under the age of 16, and we do not knowingly collect personal information from children. The Platform may contain links to other websites and online services, such as social media websites, that are not operated by us. These links are not an endorsement of, or representation that we are affiliated with, any third party. If you click on a third-party link, you will be directed to that third party's site or service. Cross-Border Data Transfer. Fluxon complies with the EU-U.S. Data Privacy Framework program (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework program (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Fluxon has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Fluxon has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework program Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Onward Transfer. Fluxon remains responsible for any of your personal information that is shared under the Onward Transfer Principle with third parties for external processing on our behalf, as described in the “Sharing of Personal Information” section of this Privacy Policy.

Complaints. In compliance with the EU-US Data Privacy Framework Principles, Fluxon commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to the DPF Principles. European Union, Swiss and United Kingdom individuals with DPF inquiries or complaints should first contact Fluxon at Fluxon is also subject to the investigatory and enforcement powers of the US Federal Trade Commission.

Fluxon has further committed to refer unresolved privacy complaints under the DPF Principles to an independent dispute resolution mechanism, Data Privacy Framework Services, operated by BBB National Programs.
